My disability insurance company terminated my benefits due to a change in the disability definition; what’s going on?

Disability insurance policies can be complicated. Your policy will have a definition for “Disability” or “Total Disability” to qualify for benefits. Many policies state that for the first 24 months, you qualify where you are unable to perform the essential duties of your own occupation (the “Own Occupation Test”). After that, you are disabled if you are unable to perform any occupation for which you are reasonably qualified for by reason of your education, training or experience (the “Any Occupation Test”); even if that work is not available in your region. Some policies provide coverage to age 65, while some are shorter periods like five years. Some will state that if you earn a certain percentage of your pre-disability income then you are denied. The best advice; review your policy before you become disabled and if you are denied, visit a personal injury lawyer.
